EAPA Cons. Case 7724: WHP Associates LLC (Notice of Determination as to Evasion, May 1, 2023)

EAPA Action: Notice of Determination as To Evasion in EAPA Cons Case 7724 - Thermal Paper

WASHINGTON — On May 1, 2023, CBP issued the notice of determination as to evasion for EAPA consolidated case 7724 filed by the Paper Receipts Converting Association, against U.S. importer, WHP Associates LLC (WHP) for evasion of the applicable AD/CVD orders A-570-920; C-570-921; and A-580-911 on thermal paper from China and South Korea. Specifically, evidence on the record that shows reported manufacturer Actan (Malaysia) SDN BHD converts the jumbo rolls of either Chinese-origin and/or South Korean-origin into smaller thermal paper rolls that are then exported to the United States and imported by WHP. CBP has determined that there is substantial evidence of evasion of AD/CVD duties by WHP and, therefore, CBP issued a formal notice of determination as to evasion and has taken enforcement actions.

In light of CBP’s findings, CBP will:

  • CBP will suspend or continue to suspend the entries covered by this investigation, until instructed by Department of Commerce to liquidate.
  • For those entries previously extended in accordance with Interim Measures, CBP will rate adjust and change those entries to type 03 and continue suspension until instructed by Department of Commerce to liquidate these entries.
  • CBP will continue to evaluate WHP’s continuous bonds in accordance with CBP’s policies.
