QB 24-799 2024 Interim Section 232 Aluminum Articles of European Union (EU) Member Countries

2024 Interim Notice

Start of period:

January 2, 2024 12:01 AM Local Port time.

CBP is preparing for the deployment of the 2024 EU Aluminum TRQ program.  The 2024 EU aluminum quotas will be put in a “Hold” status, allowing entries for quota type merchandise to proceed in 2024.  All properly filed entries will receive a “Quota Pending” message.

When the quota “Hold” is released quota will be accepted in first come, first served order based on the quota presentation dates of entries entered on hold.  Quota limits will be filled chronologically until one or more entries with the same time stamp exceed programmed limits.  These entries will be prorated.  Entries with later presentation dates will be rejected to be refiled as over-quota entries.

Trade should proceed following existing 2023 guidance until the 2024 program is finalized:

(See note below.)  Quantities above the apportioned amount must be entered using another method listed below.  Exclusion lines and over-quota lines can be combined on a quota entry.

Individual Importer Product Exclusion ID entries:

All entries with an importer-specific Department of Commerce (DOC) approved product exclusion ID can be combined on a quota entry or filed using quota entry type code 02, 06, 07, 12, 23, 32, 38, or 52.  Filers must use HTS 9903.85.25 as the first HTS number followed by any additional Ch 99 HTS numbers (if required), and then the Ch 76 classification HTS number of their goods as the next HTS number.  Filers with a DOC approved exclusion must include their Product Exclusion ID number on the entry.  Exclusion entries are limited by the date and volume listed in the DOC information provided to the importer.  Exclusion lines and over-quota lines can be combined on a quota entry.

Background:

Presidential Proclamation 9704 of March 8, 2018 provided for tariffs in Section 232 Steel and Aluminum.

Presidential Proclamation 9777 of August 29, 2018 provided for relief from Section 232 limitation on an individual basis via a DOC issued exclusion.

DOC Bureau of Industry and Security Interim Final Rule “Section 232 Steel and Aluminum Tariff Exclusions Process” 2020-27110 established General Approved Exclusions (GAEs) for specific HTS numbers to be used by any importing entity.  This rule was updated effective December 27, 2021 by FRN 2021-26634 to remove 26 GAEs from the section 232 steel list and 4 GAEs from the section 232 aluminum list.  Notes at the bottom of this document have been updated to reflect this change.

Presidential Proclamation 10327 of December 27, 2021 established a Tariff Rate Quota for member countries of the European Union and provided for semi-annual limits on Section 232 Aluminum commodities of 9903.85.25 – 9903.85.44.

Proclamation 10522 of February 24, 2023 Adjusted duties on Aluminum imports from Russia.

Exclusions

Importers may apply for exclusions from the DOC.  The DOC provides exclusion effective dates and quantity limits to each successful applicant.

When utilizing the GAE HTS numbers, an additional individual exclusion ID number is not required.
