QB 20–317 2020 Specialty Sugar Period 6

Due to a typographical error published in U.S. Department of Agriculture’s Federal Register Notice dated June 27, 2019 (84 FR 30691), the limit for Specialty Sugar Period 3 was processed for 55,000,000 kilograms instead of the intended 50,000,000 kilograms.  To correct this quantity error, the United States Trade Representative (USTR) is reducing the limit of Specialty Sugar Period 5 to 30,000,000 kilograms, combining it with Specialty Sugar Period 4 (35,000,000 kilograms), to establish this Specialty Sugar Period 6 for 65,000,000 kilograms. 

THIS QUOTA IS EXPECTED TO OVERSUBSCRIBE AT OPENING MOMENT

All entries submitted between 12:00 AM (midnight) local port time on OPENING DAY and prior to 12:00 PM Eastern Time (ET) OPENING DAY will be counted TOWARD OPENING MOMENT at 12:00 PM ET.  Entry summaries reported early or late, (before 12 Midnight Local Port Time or after 12 Noon ET), will not be processed for the opening, however; early entries may be retransmitted within the proper time range for OPENING MOMENT.  Please note: For remote filers, the port of entry dictates the time and date of presentation for quota purposes. 

Please immediately report transmission problems to the HQ Quota and Agriculture Branch (QAB) HQQuota@cbp.dhs.gov.  Notification delays may result in exclusion from the opening.  Entry summaries with transmission issues submitted late will be reviewed and handled by QAB on a case-by-case basis.

Trade Instructions: Please ensure warehouse entry summaries associated with the withdrawals are not finalized in ACE, if you experience any issues please contact Headquarters Quota and Agriculture Branch immediately.

CBP Instructions:  CBP Center and Port of Entry personnel should refrain from processing collections with final collection code 092, warehouse withdrawals payment should only be processed using collection code 002. Quota warehouse withdrawal final collection code close out (using collection code 092) with zero duty amount may be processed by CBP, once the warehouse ledger information is submitted by the warehouse proprietor to CBP.

Failure to follow these instructions may cause ACE processing problems and/or cargo release delays.                 

To ensure reporting accuracy prior to establishing the Prorata Percentage, associated entries are held 72 hours.  After the proration percentage is calculated, QAB will release the holds and ACE filers will receive a UC message indicating the reserved or prorated quantity per reported quota line. 

Unique 9903 Harmonized Tariff Schedule Numbers (HTS) have been created and combined to the current tariff numbers, to identify Specialty Sugar Periods.  If entry summaries are misclassified, they will not be included in the opening.

After the quota closes, merchandise may be entered at the over-quota classification (as indicated in the Harmonized Tariff Schedule) as a 01 entry type in ACE.
