EAPA Action: Notice of Investigation and Interim Measures in EAPA Case 7783 – Quartz Surface Products

WASHINGTON—On February 2, 2023, U.S. Customs and Border Protection (CBP) issued its notification of initiation of investigation and interim measures against Superior Commercial Solutions LLC (Superior) in Enforce and Protect Act (EAPA) investigation 7783, examining the evasion of antidumping and countervailing duty (AD/CVD) orders A-570-084 and C-570-085 on quartz surface products (QSP) from the People’s Republic of China (China).  CBP found there was reasonable suspicion that Superior had been entering covered merchandise from China that had been transshipped through Vietnam and had been misclassified as non-covered merchandise.

In light of CBP’s determination and pursuant to its authorities under EAPA, CBP will:

  • Require “live” entry for imports of QSP, meaning Superior must submit proper import documentation and duties prior to the release of its merchandise;
  • Suspend liquidation of entries made after initiation of the investigation and extend liquidation of entries made before the initiation; and
  • Review Superior’s continuous bonds and application of single transaction bonds for its entries, as appropriate.
