WASHINGTON — On July 06, 2022 U.S. Customs and Border Protection (CBP) issued a Notice of Investigation and Interim Measures as a part of an ongoing Enforce and Protect Act (EAPA) investigation, EAPA Case 7705 into the alleged evasion of Antidumping and Countervailing Duty (AD/CVD), Order A-570-106 and Order C-570-107, Wooden Cabinets and Vanities from the People’s Republic of China (China). During its investigation, CBP established reasonable suspicion that Valleywood entered covered merchandise into the customs territory of the United States through evasion, CBP has imposed interim measures.
CBP is taking the following interim measures against the importers to protect U.S. revenue:
- suspend the liquidation of each unliquidated entry of such covered merchandise that entered on or after March 30, 2022, the date of the initiation of the investigation
- pursuant to the Commissioner’s authority under section 504(b), extend the period for liquidating each unliquidated entry of such covered merchandise that entered before the date of the initiation of the investigation; and
- pursuant to the Commissioner’s authority under section 623, take such additional measures as the Commissioner determines necessary to protect the revenue of the United States, including requiring a single transaction bond or additional security or the posting of a cash deposit with respect to such covered merchandise.
These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
