EAPA Action: Notice of Determination as to Evasion in EAPA Case 7722 - Quartz Surface Products

WASHINGTON— On June 14, 2023, CBP issued the notice of Determination as to Evasion for EAPA Case 7722, filed by Cambria Company LLC, against U.S. importer, Vanguard Trading Company LLC (Importer) for evasion of the applicable AD/CVD orders A-570-084 and C-570-085 on quarts surface products (QSP) from China. CBP has determined that there is substantial evidence on the record that the Importer misclassified the subject Chinese-origin QSP by describing the merchandise as “artificial marble and/or artificial stone” when that merchandise should properly be described as QSP.

In light of CBP’s findings, CBP will:

  • Suspend or continue to suspend the Importer’s entries subject to this investigation until instructed to liquidate these entries;
  • Rate adjust and change those entries previously extended in accordance with the interim measures to type 03 and continue suspension until instructed to liquidate these entries; and
  • Review the Importer’s continuous bonds and require single transaction bonds, as appropriate.
