EAPA Action: Notice of Determination as to Evasion in EAPA Case 7718 - Wooden Bedroom Furniture

WASHINGTON— On July 21, 2023, CBP issued the notice of determination as to evasion for EAPA case 7718 filed by CVB Inc., dba Malouf® (“CVB Inc.”), against U.S. importer, Zinus Inc. (USA) (“Zinus US”) for evasion of the applicable AD order A-570-890 on wooden bedroom furniture (“WBF”) from China.  Specifically, evidence on the record shows Zinus US imported Chinese origin WBF by using a general product description and misclassified the WBF as non-covered merchandise. CBP has determined that there is substantial evidence of evasion of AD duties by Zinus US and, therefore, CBP issued a formal notice of determination as to evasion and has taken enforcement actions.

In light of CBP’s findings, CBP will:

  • Suspend or continue to suspend Zinus US’s entries covered by this investigation, until instructed to liquidate these entries;
  • For those entries previously extended in accordance with Interim Measures, CBP will rate adjust and change those entries to type 03 and continue suspension until instructed to liquidate these entries; and
  • Review Zinus US’s continuous bonds and require single transaction bonds, as appropriate.
