In the early morning hours of February 12, 2018, a Supervisory CBP Officer (SCBPO) was awoken in her home by the sound of an intruder. The intruder gained entry into the SCBPO’s residence by breaking the glass in a sliding door.
In response to the intrusion, the SCBPO moved to the closet in the master bedroom, retrieved her CBP-issued handgun, and identified herself by yelling, “Police, Police” several times. When the intruder entered the bedroom and advanced in the direction of the SCBPO, the SCBPO fired multiple rounds, striking the intruder. The SCBPO immediately contacted 911 for police and medical assistance, but the intruder died at the scene.
Result of the NUFRB
On March 14, 2019, the CBP National Use of Force Review Board (NUFRB) considered whether the discharge of a CBP-issued handgun by the SCBPO was in compliance with CBP use of force policy. The NUFRB concluded the discharge of a CBP-issued handgun by the SCBPO was in compliance with CBP use of force policy in effect at the time of the incident.
NUFRB Recommendations
Consistent with the mandate to review and report on potential improvements to policy and training, the NUFRB made a formal recommendation following their consideration of this incident.
