HELP provides for increases in the knit and woven apparel TPL limits by means of a trigger quantity mechanism.  If either TPL reaches an entered quantity of 52 million square meter equivalents (SME), the President may authorize an increase in these limits by an amount up to 200 million SME.  Additionally, at that point sub-limits of 85 million SME for the knit TPL and 70 million SME for the woven TPL are activated for designated products.  HQ Quota plans to set the threshold for these TPLs at 50 million SME rather than the traditional 95% amount.  This will allow enough time to plan for the programming changes that will be needed to accommodate the new legislation.

REPORTING INSTRUCTIONS:

Use entry type code 02, 06, 07, 12, 23, 32, 38, or 52.

Report in units of measure as shown in the Harmonized Tariff Schedule. Conversion to square meter equivalency will be done by the computer.

Merchandise presented at the opening shall be reported and released via the quota module of ACS until a “hold” status is indicated.

SPECIAL INSTRUCTIONS:

Input into the quota module is also required for those provisions which require a visa but are not subject to a quantitative restraint.  In all instances, ports should report the visa number in the visa field of the quota input screen.

Whenever goods are classified under provision 9820.61.35 or 9820.62.05 as ensembles in combination with a designated ensemble provision in chapter 61 or 62, the reporting number shall be for the specific component apparel article in the ensemble and not the ensemble number.  Each specific apparel article in the ensemble must be identified separately by using the appropriate chapter 61 or 62 provision in combination with 9820.61.35 or 9820.62.05.

Once the in-quota allocation is filled, goods will be allowed to enter at normal trade relations rate or general rate of duty as noted in the HTS.
