TUCSON, Ariz. – Tucson Sector Border Patrol agents assigned to the Douglas Station arrested a previously deported 40-year-old Mexican male national Wednesday night and discovered he was convicted and incarcerated for sexual assault of a child in Florida in 2004.

Agents patrolling west of the Douglas Port of Entry arrested Roberto Garcia-Galicia shortly after he illegally entered the United States.

Agents transported Garcia to the Douglas Station where fingerprint and database records checks revealed he was convicted of sexual assault of a person under 12 years of age and sentenced to 12 years in state prison.

Garcia will remain in federal custody pending prosecution for criminal immigration.

Federal law allows agents to charge individuals by complaint, a method that allows the filing of charges for criminal activity without inferring guilt. An individual is presumed innocent unless and until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.

Customs and Border Protection officials welcome assistance from the community. Citizens can report suspicious activity to the Border Patrol by calling 1-877-872-7435 toll free. All calls will be answered and remain anonymous.
