EAPA Action: Notice of Investigation and Interim Measures in EAPA Case 7785 - Cast Iron Soil Pipe and Cast Iron Soil Pipe Fittings

WASHINGTON — On February 1, 2023, U.S. Customs and Border Protection (CBP) issued its notification of initiation of investigation and interim measures as to evasion by LDL Trading Company (LDL Trading) in Enforce and Protect Act (EAPA) investigation 7785, examining the evasion of antidumping and countervailing duty (AD/CVD) orders A-570-079 and C-570-080 on cast iron steel pipe (CISP) from the People’s Republic of China (China) and AD/CVD orders A-570-062 and C-570-063 on cast iron soil pipe fittings (CISPF) from China.  CBP found there was reasonable suspicion that LDL Trading had been entering covered merchandise from China that had been transshipped through Malaysia and had been misclassified as non-covered merchandise.

EAPA Action: Notice of Investigation and Interim Measures in EAPA Case 7782 - Forged Steel Fittings

January 19, 2023 | EAPA Action

WASHINGTON — On January 19, 2023, U.S. Customs and Border Protection (CBP) issued a notice of investigation and interim measures in Enforce and Protect Act (EAPA) investigation 7782.   In this case, CBP is investigating whether the importer, YVC USA Inc. (the Importer) evaded antidumping duty (AD) order A-570-067 and countervailing duty (CVD) order C-570-068 on forged steel fittings (covered merchandise) from the People’s Republic of China (China).  CBP found there was reasonable suspicion that the Importer entered covered merchandise from China that was transshipped through Sri Lanka.

EAPA Action: Notice of Investigation and Interim Measures in EAPA Case 7734 - Aluminum Extrusions

January 24, 2023 | EAPA Action

WASHINGTON — On January 24, 2023, U.S. Customs and Border Protection (CBP) issued its notification of initiation and interim measures as to evasion by Fortress Iron, LP, also referred to or doing business under the names Fortress Fence Products and Fortress Building Products (“Fortress”) in Enforce and Protect Act (EAPA) investigation 7734, examining the evasion of antidumping duty (AD) and countervailing duty orders, A-570-967 and C-570-968, respectively, on aluminum extrusions from the People’s Republic of China (China).  CBP found there was reasonable suspicion that Fortress had been entering covered merchandise from China but not declaring them as subject to those AD/CVD orders.

WASHINGTON — On January 24, 2023, U.S. Customs and Border Protection (CBP) issued its notification of initiation and interim measures as to evasion by E-Merchant Supplies, A2 Labels & Rolls, POS Supply Solutions, Royal Paper Products (otherwise known as AmerCare Royal LLC), Golden Eagle Distributors LLC, Paper Roll Supplies LLC, Lucky Heap, National POS Paper, Paper Roll Products, BuyRolls Inc., Qualita Paper Products (otherwise known as Quality Paper Products), VBS Cal LLC, Allied Paper Company, and The Advantage Group (collectively, the Importers) in Enforce and Protect Act (EAPA) investigation 7745, examining the evasion of antidumping duty (AD) orders A-428-850 on steel grating from the People’s Republic of China (China).  CBP found there was reasonable suspicion that the Importers had been entering covered merchandise from Germany that had been transshipped through Mexico, or been entering covered merchandise from Germany that had been misclassified as non-covered merchandise

(Kingway), Nio Kitchen Depot Inc. (Nio), Nomadic Barters Inc. (Nomadic), and Opaly USA LLC (Opaly), as well as several of their doing-business-as (DBA) names, Artist Kitchen and Stone Inc. (Artist Kitchen), MS Stone Co. Ltd. (MS Stone), and Nio Home Depot Inc. WASHINGTON—On July 22, 2022, U.S. Customs and Border Protection (CBP) issued a determination as to alleged evasion by Nutrawave Co., Ltd.; Starille, Ltd.; and Newtrend USA Co., Ltd. (collectively, “ the importers”) for evading customs duties in Enforce and Protect Act (EAPA) Consolidated Case 7663. Specifically, CBP investigated allegations of evasion of antidumping duty (AD) order A-549-837 on glycine from Thailand. CBP found that substantial evidence did not exist that the importers imported the covered merchandise from Thailand by transshipping it through Indonesia and without paying AD duties.

During its investigation, CBP established reasonable suspicion that Valleywood entered covered merchandise into the customs territory of the United States through evasion, CBP has imposed interim measures.

WASHINGTON — On May 24, 2022, U.S. Customs and Border Protection (CBP) issued a Notice of Investigation and Interim Measures as a part of an ongoing Enforce and Protect Act (EAPA) investigation, EAPA Case 7699, into the alleged evasion of Antidumping and Countervailing Duty (AD/CVD), Order A-570-067 and Order C-570-068, involving forged steel fittings from the People’s Republic of China (China). During its investigation, CBP established reasonable suspicion that C.I.S. Investments, LLC d/b/a Triangle Metals, LLC. (Triangle) imported forged steel fittings from China by transshipping them through Sri Lanka, Indonesia, and Thailand, potentially evading a significant amount in AD/CVD duties owed to the U.S. Government.

EAPA Action: Notice of Determination as to Evasion in EAPA Case 7469 - Common Alloy Aluminum Sheet

WASHINGTON—On March 21, 2022, U.S. Customs and Border Protection (CBP) issued a determination on whether AA Metals Inc. (AA Metals), in Enforce and Protect Act (EAPA) Consolidated Case 7469, evaded customs duties. Specifically, it examined the evasion of antidumping and countervailing Duty (AD/CVD) orders A-570-073 and C-570-074 on common alloy aluminum sheet (aluminum sheet) from the People’s Republic of China (China).  CBP found there was substantial evidence that the importer had transshipped certain merchandise subject to the orders through Turkey.

(collectively, Splendid Trading) and Superior Granite and Marble by Vivaldi LLC (also doing business as Vivaldi Interiors LLC and Vivaldi Commercial LLC) (collectively, Superior) for evading customs duties in Enforce and Protect Act (EAPA) Case 7607.  Specifically, CBP examined whether Splendid Trading and Superior evaded antidumping and countervailing duty (AD/CVD) orders A-570-106 and C-570-107 on wooden cabinets and vanities and components thereof (WCV) from the People’s Republic of China (China).  CBP found substantial evidence that Splendid Trading and Superior imported into the United States WCV from China that was transshipped through Malaysia and did not pay AD/CVD duties.

WASHINGTON—On August 10, U.S. Customs and Border Protection (“CBP”) issued its determination as to evasion against Lyke Industrial Tool, LLC (“Lyke”) in its Enforce and Protect Act (“EAPA”) investigation 7250 into the evasion of an antidumping duty (“AD”) order for diamond sawblades from the People’s Republic of China (“China”). EAPA found that substantial evidence exists that Lyke evaded antidumping duty order A-570-900 by transshipping diamond sawblades from China through Thailand. As a result, Lyke evaded a significant amount of antidumping duties owed to the U.S. Government.

WASHINGTON—On June 29, U.S. Customs and Border Protection (CBP) issued a Notice of Investigation and Interim Measures as a part of an ongoing Enforce and Protect Act (EAPA) investigation, EAPA Case 7604, into the alleged evasion involving quartz surface products (“QSP”) from The People’s Republic of China (China). During the course of its investigation, CBP developed a reasonable suspicion that Simpli Home, Ltd. EAPA Action: Notice of Determination as to Evasion in EAPA Case 7474 - Certain Steel Grating

WASHINGTON—On June 21, U.S. Customs and Border Protection (CBP) issued its determination as to evasion by Ikadan System USA, Inc. (“Ikadan”) and Weihai Gaosai Metal 2 Product Co., Ltd. (“Gaosai”) (collectively, the Importers) in its Enforce and Protect Act (EAPA) investigation, EAPA Case 7474, into the evasion of antidumping and countervailing duty (AD/CVD) orders A-570-947 and C-570-948 for certain steel grating (steel grating) from the People’s Republic of China (China). CBP found there was substantial evidence that the Importers had been entering subject merchandise from China that had been misclassified. The Importers did not declare that the merchandise was subject to AD/CVD orders upon entry, and no cash deposits were collected on the merchandise. As a result, the Importers evaded a significant amount of AD/CVD duties owed to the U.S. Government.

CBP found substantial evidence that Lino evaded AD/CVD orders A-570-062 and C-570-063 by transshipping soil pipe through Cambodia. It failed to properly report these entries and to post the appropriate cash deposits. Furthermore, CBP determined that Lino set up a front company during its investigation to evade CBP’s interim measures.

CBP found substantial evidence that Blue Star and Lino evaded AD/CVD orders A-570-079 and C-570-080 by transshipping soil pipe through Cambodia.
