EAPA Cons. Case 7913: Various Importers (Notice of Determination as to Evasion, May 29, 2025)

Notification of Determination as to Evasion in EAPA Consolidated Case 7913 – Mattresses from China 

WASHINGTON—On May 29, 2025, U.S. Customs and Border Protection (CBP) issued its notice of determination as to evasion by Alexand Inc. (Alexand), Alloech Inc. (Alloech), Anlowo Inc. (Anlowo), Bentensh Inc. (Bentensh), Calimoon Inc. (Calimoon), Day Day Up Inc. (Day Day Up), Deluxe Home of USA Inc. (Deluxe Home), Gemmeo Inc. (Gemmeo), Haiide Inc. (Haiide), Hondex Inc. (Hondex), Incoroy Inc. (Incoroy), Inland Empire Decor Home Furnishing Inc. (Inland Empire), Lincody Inc. (Lincody), Lirachy Inc. (Lirachy), Newland Technology Inc. (Newland), Outlier Inc. (Outlier), Splendid Life Distribute Inc. (Splendid Life), Startown Inc. (Startown), Sunshine International Inc. (Sunshine Intl), Vovyace Inc. (Vovyace), Weekaly Inc. (Weekaly), Wuleitex Inc. (Wuleitex), and Zozonid Inc. (Zozonid) (collectively, the Importers) in Enforce and Protect Act (EAPA) consolidated investigation 7913, examining the evasion of antidumping duty (AD) order A-570-092 and countervailing duty (CVD) order C-570-128 on mattresses from the People’s Republic of China (China). Based on the record of the investigation, CBP found there was substantial evidence that the Importers entered covered merchandise from China that was transshipped through various countries. 

In light of CBP’s determination that the Importers entered covered merchandise into the customs territory of the United States through evasion, and pursuant to its authorities under EAPA, CBP will: 

  • CBP will suspend or continue to suspend the entries covered by this investigation, until instructed to liquidate. 
  • For those entries previously extended in accordance with Interim Measures, CBP will rate adjust and change those entries to type 03 and continue suspension until instructed to liquidate these entries. 
  • CBP will continue to evaluate the Importers’ continuous bonds in accordance with CBP’s policies. 

These actions do not preclude CBP from taking additional enforcement measures as it determines appropriate under its EAPA or other legal authorities, which include pursuing civil penalties or investigations into criminal violations.
